End User License Agreement

End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you and Josiah Brown ("Licensor") regarding the use of the Simple Cinema mobile application ("Application"). By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not use the Application.

1. License Grant

You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to use the Application solely for personal, non-commercial purposes on a mobile device that you own or control, and as permitted by the Apple App Store Terms of Service.

2. Restrictions

  • You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application.
  • You may not modify, adapt, translate, rent, lease, lend, sell, redistribute, or sublicense the Application.
  • You may not remove or alter any proprietary notices or labels on the Application.
  • You may not use the Application for any unlawful purpose or in any manner inconsistent with this Agreement.

3. Ownership

All rights, title, and interest in and to the Application, including all intellectual property rights, are and shall remain the exclusive property of the Licensor. This Agreement does not convey to you any ownership interest in the Application.

4. User Content

Any content you submit via the Application remains your property. However, you grant the Licensor a worldwide, royalty-free, sublicensable license to use, host, store, reproduce, and display your content solely for operating the Application.

5. No Warranty

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION.

7. Termination

This Agreement is effective until terminated. It may be terminated by the Licensor at any time without notice if you fail to comply with any terms of this Agreement. Upon termination, you must cease all use of the Application and delete all copies from your device.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
